Notice of SEPA Action and Public Hearing Rattlesnake Flat Wind Project Conditional Use Permit (CUP) (Case Number LUA2017-0007)

NOTICE IS HEREBY GIVEN that the County has received a Conditional Use Application including an Applicant-prepared Expanded SEPA Checklist in compliance with ACC 17.70.060(B). Pursuant to RCW 43.21(C), Adams County Building and Planning Department made a Mitigated Determination of Non-Significance (MDNS) for Rattlesnake Flat, LLC, a subsidiary of NRG Renew LLC for a Conditional Use Permit (CUP) application to construct a commercial-scale wind energy generation facility consisting of up to 90 wind turbines and associated facilities on approximately 23,000 acres of leased, agricultural zoned land in unincorporated Adams County, Washington.
 
Commercial wind energy facilities are conditionally permitted in the County’s prime agricultural zoning district under ACC 17.080.040 “District Use Chart”, by a CUP.  Adams County reviews and authorizes permit applications for wind energy projects through ACC 17.70. Such projects must comply with the standards of ACC 17.70 rather than the general conditional use permit standards and criteria set forth under ACC 17.68 - Conditional Uses.  In addition to the CUP, the County’s SEPA review is conducted in tandem with the Washington Department of Natural Resources (DNR) with respect to a potential lease of State lands for a portion of the Rattlesnake Wind Project.  DNR is acting as a cooperating SEPA agency.  In that capacity, DNR has separately reviewed the Expanded SEPA Checklist and concurs with the MDNS. 
 
The Project is located in Adams County in east-central Washington approximately 15 miles south of Ritzville, Washington in a rural, lightly populated area that is characterized primarily by agricultural use. Highways near the Project include Highway 21 to the west, Highway 261 to the east, Highway 26 to the south, and Highway 395 to the north. The Project occurs in portions of the following PLSS township/range/sections:

Township 16 N, Range 35 E, Sections 1-16, 22-26, 35-36
Township 16 N, Range 36 E, Sections 7, 17-21, 29-30

STATE ENVIRONMENTAL POLICY ACT (SEPA):
Determination: Adams County, as the lead agency for this proposal, after reviewing a completed Expanded Environmental Checklist and other information on file with the lead agency, has determined that the project will not have a probable significant adverse impact on the environment, and an environmental impact statement (EIS) will not be required under RCW 43.21C.030(2)(c), provided the mitigation measures are used to mitigate potential adverse impacts. The information relied upon in reaching this determination are available as noted below.
 
This decision is made after review of a completed environmental checklist and other information on file with the lead agency. This Mitigated Determination of Non-significance (MDNS) is issued pursuant to WAC 197-11-350. Adams County will not act on this proposal for at least 17 days from June 21, 2018. Timely comments on this threshold determination must be received no later than 4:30 PM, Monday July 9, 2018.

NOTICE OF PUBLIC HEARING BEFORE THE ADAMS COUNTY BOARD OF ADJUSTMENT
 
 
NOTICE IS HEREBY GIVEN by the Adams County Board of Adjustment that a public hearing will be held on August 1, 2018 at 7:00 PM. in the Adams County courtroom, 425 E. Main Ste.400, Othello, WA 99344. The purpose of the public hearing is to receive and consider verbal and written testimony regarding a Conditional Use Permit for the development of commercial-scale wind energy generation facility located on approximately 23,000 acres of leased, agricultural zoned land in unincorporated Adams County, Washington.
NOTICE IS FURTHER GIVEN that a topic of discussion at the hearing may be any environmental documents that have been prepared in conjunction with the proposed conditional use application. A Determination of Mitigated Non-significance was issued on June 18, 2018 by the Adams County Building and Planning Department SEPA official with a comment and appeal period ending July 9, 2018.
